BDM103 - Trademark Disputes
iPhone vs MyPhone
Apple made a trademark claim against Solid Broadband, a local phone company of the Philippines.
Apple had complained of Solid Broadband’s application for trademark, citing “confusingly similar” resemblance to the iPhone, which it said was “likely to deceive or cause confusion.”
But IPO said there was no sufficient proof to conclude that there was a confusing similarity between the two lines: “While the marks are similar with respect to the word (‘phone’), it is not sufficient to conclude that confusion among the consumers is likely to occur. ‘Phone’ is a generic term for mobile phones products.”
“The fame and popularity of iPhone in fact makes it improbable for one to confuse MyPhone product as an iPhone,” it added.

It was a complaint surrounding a man in an art gallery who asked if there had ever been a fire in the premises. The next scene showed a man carrying a painting on fire through the gallery.
The complainant had said that he has experience the loss of a relative by fire and that the portrayal of the man on fire was offensive. He also said that the advertisement made a mockery of the Fire Service's campaign to prevent fire and deaths.

Complainant was a C. Stewart. Against Frucor Beverages Limited on a V Energy Drink television advertisement.

DMCA Takedown Notice - BDM103
Dramacrazy.net
The takedown notice was on distributing infringing content.The parties involved were different networks throughout Asia who’s content was in the website.
The website was ultimately shutdown.
Vimeo and Pixels
The claim of infringement is obscure apart from having he word Pixels in the title.
The claim was made by Entura International, an ‘anti-piracy’ organization acting on behalf of Columbia Pictures.
One of the video that was taken down was a 2006 short film called Pixels. They expressed their disdain and the fact that it was technically ‘strike one’ if they infringed.
Most of the other videos taken down had no relation to the Adam Sandler film apart from the title…with the sole exception of it’s own trailer.
It even took down the source material, a two minute CGI film where the video game icons came to life.
After some time, the video were finally restored.

Getting permission from a copyright owner
Essentially, the document talks about the processes of
obtaining a copyright and legal matters surrounding a copyright.
It list major acting bodies of copyright representatives
where an individual may wish to obtain a licence. Different bodies represent
different media and for different settings.
The document also talks about the different types of licences and
what would constitute as a copyright infringement.
Defence against a copyright infringement would not be applied if

contact the copyright owner.

If you merely acknowledged the
creator/copyright owner.

If you have wrongly used the relevant
copyright work from the creator’s request.
Infringement of Copyright – What Should I Do?
Discusses what
an infringement is, then continues on to what may or may not be considered a
‘substantial part’ that is used from the original material. Grey area on what
constitutes as a substantial part but ultimately digresses that even a minimal
part e.g. a few bars from a music sheet could be an infringement case.
Coincidental
similarities does not constitute as an infringement case, it would only be
infringement if the resulting similarity was gained by direct or an indirect
form of copying.
Authorising an
infringement, which the document says “sanction, approve or countenance” as an
act of authorisation, will also incur the practitioner an infringement case.
The document
then goes on about certain situations in which one would be allowed to use
copyrighted material the permission of the copyright holders. This is for such
things as research or private study, criticism, reviews or news reporting. Certain
bodies also have certain exceptions to infringement.
The latter half
of the document is if you’re the copyright owner and your works are being
infringed upon, there are certain things you would be able to do such as
contact representative copyright bodies that pertains to your medium.
You may then
decide on a course of action.

decide to make an informal contact with the infringer.

Copyright Infringement
Ultimately forced by YG Entertainment (2NE1’s label) to stop promotion and any performance of the song and remove the video from YouTube.
“The estate points to a 2014 US supreme
court ruling that Conan Doyle’s final 10 stories about Holmes, published
between 1923 and 1927, remain in copyright in the US under the country’s
95-year rule. While the detective’s retirement is referenced in earlier works,
the new suit says, Doyle’s later stories include “much more about Sherlock
Holmes’ retirement and later years” – in particular, the detective’s efforts to
solve one final case, how he has “come to love nature and dedicates himself to
studying it”, and how he develops “a personal warmth and the capacity to
express love for the first time”.

Dead End cover
Updated my design for the cover. Literally 80% has been changed concerning the figures.
As a comparison, my initial design below on the left with my new design on the right (New font pending)
Proposal Pages
My current design for the Title and Contents page for the proposals. I wanted to keep the Film Noir vibe, keeping the black and white colour. I also wanted a greater throw back to those kinds of films hence the brick wall background. I wanted to include my two main (the anti-hero and the femme fatale) characters in them without it seemingly forced so I made my characters essentially into 'graffiti' of the brick wall which I liked how it turned out to.

Frame Test 2
A more 'refined' version of the original test frame.
I removed most of the black lines apart from the table. I gave Tyler shadows to give him a more 3D presence. The blue colour of his jersey has also be swapped for a more in-line grey to the theme.
Overall the composition has given the test frame a much more 'moody' setup.

Animation Idea
For my 2D animation assignment, I plan to use my storyboard story as it is there and can be easily realized for the animation.
Because of the setting of the story, I wanted my style to reflect the age group I'm portraying aka young kids, so I wanted my style to be similar to that of animations aimed for them.
A style I have thought about was something similar to Aladdin the TV Series. It uses fairly average line thickness and uses one tonal colouring. The design is also fairly simple. The background on the other hand uses a more detailed approach.
One thing though is that I don't actually want to use colour in animation. I want it to be black and white from the namesake origins. Film Noir. I believe it just adds more to the irony of the whole animation.

"A Fox Tale" Review
"A Fox Tale" is a graduation film from four students;
Thomas Bozovic: 2D research, modelling, animation, matte painting
Alexandre Cazals: Colourboard/lightboard, modelling, environments lookdev, texturing/shading, lighting, rendering , compositing
Julien Legay: 2D research, modelling, FX, fur, layout
Chao Ma: Original idea, character design, modelling, animation, designs, 2D research, storyboard, layout
at Suponfucom in France.
It shows the story of two brother in the hunt for a fox who is more than what they both know. The fox, with the use of a magical pool, turns into a barely clothed woman. The she-fox then acts as a femme fatale inciting conflict within the brothers.
I enjoyed the plot and the action sequences and the 'world' details. It was enjoyable and entertaining.

Updated Character Bio
Aramiel was a warrior
angel, one of the greatest there is in Heaven. He does not remember when he was
created other than the fact that he was created under the zenith sun and that
he was created in full battle regalia with two swords upon his hands. As a
newborn angel, Aram (as he preferred to be casually called) was filled with
wonder at the marvel that was heaven. He was born with brown hair of medium
length with a streak of white at the front, his eyes a startling green and a
muscular body designed for war.
During one of his ventures he happened to see another angel dashing in the air, cleaving the winds in half with his giant scimitar. He watches for a few minutes before his presence is realised by the angel. He walks forward asking for the angel’s name.
“Zakaratiel but I prefer Zakar” the angel replied and in turn Aramiel said his own also saying that he prefers Aram.
And with that, the two angels became brothers.
Their bodies may have been that of young adults but their minds were still childlike. They explored the vastness of Heaven. They practised with their weapons when they could, Aramiel also learnt to play the flute as a way to learn something of the arts instead of just war. He enjoyed things that didn’t involve violence and war for he might have been born a warrior angel but he knew he could become more than that. Zakar on the other hand was a warrior angel through and through. He relished in the art of war and warfare. Aram sometimes envied him and sometimes pitied him.
When humanity was first created Aram was someone who envied them for unlike the angelic beings, humans were gifted with a soul, something many of the angels took as an insult for what right would creatures with short lives that is a mere blink to an angel’s.
Dissent rises among the angelic ranks with the Morningstar at the centre of it all. The Morningstar believes that humanity are not worthy of their cause and stages a plan to usurp the Creator. He gathers a large amount of the angels leading the rebellion. Aramiel as a loyal angel of the Creator, fights against the Morningstar’s army. He of course resented the fact that the fragile beings as humans were given a soul. The one thing that the angels of heaven were not given. But it was not his place nor the other’s, to challenge the will and decisions of the Creator.
During the preparation of war, Aram looked for his brother but was unable to, not with the amount of angels flying from one point to another all for the war. And so he prepared. His heart would beat at the thought of war. It might have been what he was born to do, but he did not always feel the energy of war that comes with it, not unlike the other warrior-born angels who relished upon battle.
When the great battle ensued, Aram was mortified, the idea of battle no longer had any sort of fantasised appeal as the onslaught of brother upon brother filled the great perfection that was heaven. Blood painted all that was, the streams, the grass, and the trees. Nowhere was safe from the pool of blood.
And yet there Aram was, in the centre of the battle, his brother on the ground, their cold lifeless bodies stare into the darkened sky. He clutches his swords at his sides, his stance like a tiger prepared to pounce upon its target. He watches the horizon, both armies’ number dwindling to small amounts. He sees two angels supporting another angel, appearing to escape the army but his senses tell him to confront the trio. As he goes closer he sees the red that streaked the tips of their wings, the symbol of allegiance to the Morningstar.
“Halt defactors!” He shouts at them.
They stop. The two angels lower the third and Aram’s breath stop as he realizes who the third one was; his brother, Zakar.
“Zakar? How? How could you?”
“How? How could YOU side with humanity! The gift of a soul was denied to us…US, the most perfect of all of His creations! And he gives it to them? Fragile bodies of the earth, while we of the light are denied? No, the Morningstar is right, and we will not be silenced” Zakar replies back.
“Well I cannot let you leave this place”
“I am sorry to say, but you have no say in the matter” Zakar said as he turns away limping, the two angels returning to support him.
Aram tries to go after him but it was as if his feet were glued to the ground as if magik…but he knew it wasn’t. He knew it was his own weakness, his own fault that he was unable to go after his brother. He knew plenty of brothers fought each other during this was…but he was just unable to. And he knew that this would haunt him for the rest of his life.
Great sadness befalls him for what he was unable to do.
